DELIVERY OF PRODUCTS

Paganini Foods uses standard overnight shipping services and special packaging in order to maintain the quality and integrity of your products.

To maintain the integrity of products after delivery, we recommend that you immediately refrigerate perishable items.

We guaranty your products will remain fresh in the delivery box at room temperature (78 degrees) for two (2) hours from the time of delivery.

PAYMENT

Your credit/debit card will be charged for your order on the day your order is delivered.

REFUND POLICY

We strive to make your purchase experience satisfactory. We invite and encourage your feedback, so we may improve our services. Should any problems arise, contact us within 12 hours of delivery.

For damaged or incorrectly shipped product we give you a full refund (S+H included) credited to your credit card.

If you are not satisfied for any other reason, you will receive a refund for the cost of the product only, when you return it in the original box at your cost through and overnight express service within 24 hours of delivery. Please do not return product packages without authorization.

Bear in mind that fruits and vegetables are perishable. Proper care is required. It is the responsibility of the recipient to follow any adequate care instructions in order to maintain the quality of the product.

PAGANINI FOODS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND AS TO THE AVAILABILITY, ACCURACY, OR CONTENT OF ANY INFORMATION, SERVICES, OR PRODUCTS OBTAINED THROUGH THE SITE OR THE PAGANINI FOODS SERVICES. PAGANINI FOODS DOES NOT WARRANT THAT THE FUNCTIONS PROVIDED BY THE SITE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

PAGANINI FOODS'S LIABILITY SHALL BE LIMITED TO PROVIDING YOU WITH A REFUND FOR ANY PRODUCT THAT IS RETURNED. YOUR SOLE AND EXCLUSIVE REMEDY HEREUNDER SHALL BE FOR YOU TO DISCONTINUE YOUR USE OF THE PAGANINI FOODS SERVICE AND TO TERMINATE THIS AGREEMENT. PAGANINI FOODS RESERVES THE RIGHT TO LIMIT YOUR ORDER OR THE QUANTITY OF A SPECIFIC PRODUCT YOU MAY ORDER. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES OR OF IMPLIED WARRANTIES, IN SUCH STATES AND JURISDICTIONS LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

PAGANINI FOODS controls and operates this Site from its headquarters in Harrison, New York, USA, and makes no representation that these materials are appropriate or available for use in other locations. If you use the Site from other locations, you are responsible for compliance with applicable local laws. Price and availability information is subject to change without notice.

You agree to defend, indemnify, and hold PAGANINI FOODS Parties harmless from any and all suits, actions, legal or administrative proceedings, claims, demands, damages, liabilities, and expenses, including attorney's fees and costs, arising in connection with a violation of this Agreement by you or through use of your account.
